PERSONAL DATA PROTECTION POLICY

This Personal Data Protection Policy is issued to all our existing, immediate and/or prospective membership advisors and members pursuant to the Personal Data Protection Act 2010 ("the Act") which came into force on 15 November 2013.

In the course of your dealings with MetaFin Sdn. Bhd. (“MetaFin”), we will require you to voluntarily provide data and information about yourself ("Personal Data") to enable us to deliver notices, services and / or other information in connection with our existing and future membership programs, new membership program launches and incentive campaigns.

MetaFin will follow in accordance to the s. 30(4) of the Act, where any separate entries in respect of personal data held for different purposes, a separate data access request shall be made for each separate entry.

1. Personal Data

The Personal Data refers to any information, regardless of its accuracy or form, that identifies or can be used to identify an individual. This encompasses a wide range of data including but not limited to your name, government issued IDs, date of birth, identity number, passport number, biometric data, address, gender, race, nationality, photographs and videos, contact information, e-mail address, education, occupation, marital status, religious beliefs, health records, telephone or fax number, your previous addresses, and preferred mode of communication, bank and credit card details, personal interests, and any other data to which we have or might gain access. It also includes indirect identifiers such as identification numbers and vehicle or insurance information and other information where permitted by applicable laws.

For sensitive personal data, explicit consent has to be obtained from the individual for processing of the personal data. Sensitive personal data refer to any personal data that contains any of the following attributes:

Physical or mental health
Political Opinions
Religious Beliefs
Commission or alleged commission of any offense or any other personal data as determine by the minister

Other data includes:

Demographic data (age, gender, location, etc.)
Behavioural data (website visits, app usage, etc.)
Transaction data (purchases, standing instructions, etc.)

2. Purpose

When you use our platform, we only collect the data we need to provide you with the best possible experience. Personal Data may be collected, processed and used for one or more of the following purposes:

to process your application or request on the MetaFin Platform ;
to send you information by e-mail, telephone calls, SMS or social network applications or internet social media about the membership programs, services and incentive campaigns offered by MetaFin and selected third parties that we think may interest you while we maintain control over your Personal Data;
for the delivery of notices, services or other information and the marketing of such services or membership programs whether present or future, to you;
to conduct marketing and client profiling activities regarding our latest programs, products, services and/or incentive campaigns;
for our internal record keeping and maintenance of records;
for insurance and risk management purposes;
for billing, accounting and financial purposes, including recovery of any debt owing to us;
to meet any legal or regulatory requirements imposed on us;
to facilitate any subsequent commercial transactions in relation to any incentive campaigns, membership programs and/or services; and/or
for any other purpose that is required or permitted by any law, regulations, guidelines and/or relevant regulatory authorities.

improve the performance and reliability of the platform, and develop new features and benefits for users of the platform.

We may utilise your Personal Data to promote MetaFin's products, services, events, and those of our partners, sponsors, and advertisers. Our marketing activities could include, but are not limited to:

Sending you notifications, newsletters, updates, mailers, promotional content, special privileges, and festive greetings.
Notifying you about, inviting you to, and managing your participation in our events or activities.

These communications may be delivered through various channels such as postal mail, telephone calls, SMS, online messaging services, push notifications, in-person, and email.

Should you prefer not to receive marketing and promotional materials regarding your Personal Data, you have the option to opt out. This can be done by clicking the "unsubscribe" link found in the relevant email or message. Alternatively, you can adjust your preferences directly within our App settings.

We will seek your prior agreement, consent and authorization in the event we intend to use your Personal Data for a purpose other than those that are set out above and in the privacy terms, if any, in your agreement(s) with us.

3. Source

The Personal Data will be legitimately and transparently obtained via the following manner:

official registration forms (either electronic or printed)
official Request for Information forms that are provided to you by our employees or membership advisors;
any emails, surveys or any correspondences that we have received from you requesting for information or making any inquiries;
any forms that you have submitted onto our website or any websites contracted by us;
any referral from any person or within the platform which have included his/her verifiable personal contact details;
Business cards that were dropped or given to our affiliates, employees or associates; and/or
any documents (including, but not limited to, statutory forms and returns) that were submitted to us for processing.
Participation in any campaigns, contests or any other promotional events organised by us;
feedbacks, reviews, and ratings in interaction our apps, websites or services including content interaction and features used;
vehicle data; travel data, home data entered for ownership and item verification;

When we collect Personal Data from other sources, we make sure that that data is transferred to us in accordance with applicable laws. Such sources include:

referral programmes;
our business partners, such as corporate agents, and payment providers,
service and product providers;
publicly available data;
governmental sources of data;
when our users add you as an emergency contact;
marketing services providers or partners.

At no time will any Personal Data be in any way commercially acquired, without your prior consent, from a source other than those that are set out above, such as through the purchase or trading of illegitimate and illegal Personal Data databases or lists.

4. Rights of Access

You have the right to request access to and if required, correction of your Personal Data in our records. You have the right to:

request access to your Personal Data in our records for verification purposes. You may access and review all of your Personal Data held by us, in person, at our corporate offices located at the address given in (g) below;
request the correction of your Personal Data in our records in the event the information is inaccurate, misleading, out-of-date or incomplete, upon validation and verification of the new information provided in person, at our corporate offices located at the address given in (g) below;
request that your Personal Data shall only be used for the fulfilment of the purpose of the collection of such information;
request for proof of policy and procedure in relation to the safeguard and guarantee of your Personal Data in our records;
request that we specify or explain our policies and procedures in relation to data and types of Personal Data handled by us;
communicate to us your objection to the use of your Personal Data for marketing purposes whereupon we will not use your Personal Data for these purposes, in person, at our corporate offices located at the address given in (g) below.

5. Disclosure

MetaFin rigorously upholds the confidentiality and security of your Personal Data. Nevertheless, certain business necessities may mandate the sharing of your Personal Data with specified parties in the course of conducting, management and/or operation of our business, to facilitate our services, we may need to disclose your Personal Data to the following classes of persons essential for the efficient provision of our services and may the delineated below:

Any related companies, entities and/or associates of MetaFin, including those incorporated in the future, for streamlined business operations,
Our vendors, business partners and affiliates that provide related services or products in connection with our business;
Engaged professional advisors such as our auditors, consultants, lawyers, accountants or other financial or professional advisers appointed in support of our business operations;
External third party service providers, third party management companies, sub-contractors or other parties as may be deemed necessary by us to facilitate your dealings with us. This may include:
1. Payment processing entities, facilitators;
2. Providers of background check and anti-money laundering services;
3. cloud storage providers;
4. Marketing partners and marketing platform providers;
5. Data analytics providers;
6. Research partners, including those conducting surveys or research projects in collaboration with MetaFin or on our behalf;
7. Referral partners or individual referrals on the MetaFin Platform;
8. Insurance and financing partners;
our appointed service providers in relation to our membership programs, for the purposes of delivery of admission gifts and services; and/or
law enforcement officials, government authorities.

The Personal Data provided to us will otherwise be kept private and confidential at all times and they will not be commercialized, disclosed, or shared with unauthorized third parties except as explicitly stated above. This commitment is in adherence to prevailing laws, regulations, court orders, guidelines, or codes, applicable both domestically and internationally.

Third-party affiliates are legally bound to process your Personal Data in alignment with MetaFin’s stipulated principles. They are further obligated to safeguard your Personal Data in compliance with established data protection laws and recognized industry standards.

You are entitled to rescind or adjust your consent for data disclosure at any juncture, subject to legal, contractual constraints, and a reasonable notification period. Modifications to your consent can be executed in person at our corporate headquarters, as specified in section 4.

6. Retention, Deletion, and Disposal of Personal Data

We are committed to retaining personal data only for the duration necessary to serve our business needs or as mandated by legal requirements. Should a situation arise where personal data is no longer necessary for these purposes, we ensure its secure and irreversible deletion or disposal. Alternatively, the data may be anonymized in compliance with our established deletion and disposal procedures, safeguarding confidentiality and adhering to legal standards.

7. Cookies Policy

MetaFin, along with our partners, utilizes various tracking technologies, including cookies, web beacons, tags, scripts, and local shared objects (like HTML5 and Flash, commonly known as “flash cookies”), as well as advertising identifiers (such as Apple’s IDFA or Google’s Advertising ID), collectively referred to as “Cookies.” These technologies are employed in your interaction with our Websites and Apps.

Cookies, which may be unique identifiers, can be found in multiple locations such as on your computer or mobile device, in emails from us, and on our web pages. They are used to gather Personal Data related to your usage of our Service. This may include information like your browser type, search preferences, IP address, data about the ads you've seen or clicked on, and the date and time of your usage. Cookies may be of two types: persistent (lasting beyond a single session) or session-based.

MetaFin allows third parties to place Cookies on our Websites and Apps for collecting Personal Data similar to the data we collect for ourselves. These third parties might link the Personal Data they collect with other information they have about you from different sources. Please note that MetaFin may not have direct control over or access to the Cookies used by these third parties.

Furthermore, we may share non-personally identifiable information, such as location data, advertising identifiers, or a cryptographic hash of a common account identifier (like an email address), with third parties. This is to facilitate targeted advertising.

If you prefer not to have your Personal Data collected via Cookies when using our Websites, you can deactivate cookies. This can be done by adjusting your internet browser settings to disable, block, or deactivate cookies. You can also achieve this by deleting your browsing history and clearing your internet browser’s cache. Additionally, you might be able to limit some of this data sharing through your mobile device settings.

8. Limit Processing of Personal Data

The Personal Data provided to us undergoes processing as and when required or upon scheduled maintenance. The definition of processing defines it as "any operation or set of operations which is performed upon Personal Data, whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction".

You have the right to limit, in full or in part, any of the processes by which your data is subjected to in terms of the operations allowed to be performed upon it, the period of time allowed for the performance of these operations or alternatively the deadline of the consent given.

MetaFin shall be responsible for determining the purposes and means of the processing of Personal Data.

You may at any time withdraw or amend, in full or in part, your processing consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period, in person, at our corporate offices located at the address given in 5(g) above.

9. Failure/Refusal

The Personal Data provided to us are wholly voluntary in nature and you are not under any obligation or under any duress to do so. The failure to provide the Personal Data may result in any one or more of the following, which we shall not be held liable for any of the consequences arising therefrom:

our inability to provide you with the information, services and/or products requested;
our inability to update you with the latest membership programs, services, incentive campaigns, product and/or launches; and/or
our inability to comply with any applicable law, regulation, direction, court order, by laws, guidelines and/or codes.

10. Protection

Your Personal Data will be kept and processed in a secured manner. The appropriate administrative and security safeguards, policies and procedures will be implemented, as far as practicable, in accordance to the applicable laws and regulations. We will, as far as practicable, aim to prevent any unauthorized and/or unlawful processing of, and the accidental loss, destruction or damage to your Personal Data.

Metafin is committed to taking appropriate technical, physical and organisational measures to protect your Personal Data against unauthorised access, unlawful processing, accidental loss or damage, and unauthorised destruction.

To safeguard against unauthorised access to your Personal Data by any third parties, all electronic Personal Data held by Metafin is kept, maintained and/or processed on systems that are protected by secured networks. Metafin and its related entities limit the access to any internal systems that hold Personal Data to a select group of authorised users through the use of unique identifiers and passwords. Access to Personal Data is strictly limited, provided only on a need basis, to relevant users for the purposes of performing their official duties.

Compliance with these provisions will be required of all third-party administrators who may access your Personal Data, as described under the "Disclosure of Personal Data" in Section 6 above.

11. Language

In accordance to Section 7(3) Personal Data Protection Act 2010, this Policy is issued in both Bahasa Malaysia and English languages. In the event of any inconsistency, the English language version of this Policy shall prevail.

13. Changes to this Policy

Metafin may need to modify, update and/or revise this Personal Data Protection Policy from time to time, for example, to comply with changes in business operations or laws and regulations. In any case, the latest version of this Policy will be made available on metafin.com.my at all times and accordingly, you may periodically review this website to obtain the latest information on MetaFin's privacy practices.

I hereby authorise MXM International Sdn. Bhd. ("MXM") and, where required, its affiliates and appointed service providers ("Associates") to have access to my records, laboratory test results, and other medical information ("the Information"). I understand that MXM and its Associates will treat the Information as confidential and shall not be disclosed to any Third Party.

MaximDNA Terms & Conditions:

I hereby apply for the MaximDNA Program and agree, acknowledge, and declare as follows:

I agree to be bound by the terms and conditions of the Program as detailed in the Program leaflet and the associated documentation. These terms constitute a legally binding agreement between myself and MXM.
Payment for the Program shall be as per the accompanying payment form and I agree to adhere to all terms stated therein.
In the event of a third party's credit card(s) being used for purpose of payment for the Program, I shall obtain proper authorization condoning such usage by ensuring the third-party credit card authorization, accompanied with all relevant legal documents in support of such usage (where applicable). I accept full responsibility for any claims arising from such usage.
I acknowledge that this application is subject to a cooling-off period of ten (10) working days from the date of receipt by MXM of this application ("the Cooling Off Period"). I acknowledge that I shall be entitled to a refund of the Fee provided I have not utilized any of the benefits of the Program. The cooling-off period does not apply if the contract has commenced, if genetic testing has begun, or under any other circumstances where specific contractual obligations or the nature of the services rendered preclude such a period.
In the event that I have commenced or exhausted any part of the Program or the Program test kit is incomplete or is not in a reusable condition, MXM may deduct a sum equivalent to the cost of the Program test kit pack, including any associated administration fees, processing fees, logistics or other related costs.
I acknowledge that cancellation of my membership in the Program is strictly prohibited after the Cooling Off Period and that MXM shall not refund any portion of the Fee thereafter.
The terms and conditions herein, together with the Program leaflet and the Program test kit pack shall constitute the entire understanding of the parties superseding any prior agreements or understandings.
In the event that any cheque or credit card(s) toward payment of the Fee is declined for any reason, the Program will automatically be cancelled. MXM reserves the right to terminate the Program with immediate effect. Any cost incurred under term 5 will automatically be charged to the applicant's assigned credit card as indicated in the payment form.
MXM reserves the right to vary, delete or add any of the Program benefits and/or terms and conditions at its own discretion. All updates and amendments will be posted on our official website. Please refer to our website at www.medisavers.com.my for the latest updates on any amendments.
By submitting this application, I provide informed consent for the genetic testing process, including the collection, testing, and storage of my genetic information. I acknowledge that I have read and understood the terms and conditions, including the potential risks and benefits of the Program.
I acknowledge that I have read and understood the potential benefits and risks of genetic testing as provided, but not limited to, those in the application form. These benefits include personalized health insights, family planning information, lifestyle and wellness advice, early disease identification, and participation in research. Potential risks include psychological risks, genetic discrimination, data privacy, impact on family dynamics, medical and ethical concerns, potential limitations of genetic testing.
I acknowledge that the Program includes a fee-based consultation with an appointed genetic counselor to be scheduled upon the availability of my genetic test results. This consultation will provide personalised insights based on the member's individual genetic profile, to facilitate client understanding and interpretation of their genetic test results.
The Genetic test results are not intended for diagnostic purposes and should not be used as a substitute for professional medical advice. MXM is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the test results.
MXM is committed to protecting my genetic data and will use advanced security measures to ensure its confidentiality. My genetic data will be used solely for the purposes outlined in the Program and will not be shared with third parties without my explicit consent.
I acknowledge that I may elect to receive my genetic testing report in physical and/or digital format. Where applicable, if I opt for a physical report, I may collect in person, via courier or authorise a designated third party (“Authorised Representative”) to collect on my behalf. I consent to the following:

I authorise MXM, its affiliates, and service contractors to release my physical genetic testing report to the designated Authorised Representative, which may include advisors or other authorised personnel.
I understand that the Authorised Representative is obligated to comply with applicable laws concerning the handling and delivery of my genetic testing report in accordance with the Personal Data Protection Act 2010 (PDPA). I acknowledge that my representative is responsible for upholding the confidentiality of my report and understand the consequences of non-compliance.
I accept that MXM shall not be held liable for any loss, damage, or unauthorised access or misuse of my genetic testing report arising from the actions or omissions of my Authorised Representative once it has been transferred for collection or delivery.

By submitting this application, I agree to be bound by the terms stipulated herein and any future modifications.

Upon provision of credit card, debit card, or bank account particulars, the Customer hereby grants express authorisation to MetaFin Sdn. Bhd. ("MetaFin") and/or its duly appointed collection agents (which shall include, inter alia, iPay88, Razer Merchant Services, Curlec, and any other such entities as may be appointed from time to time) to deduct all sums due in respect of Membership Fees, charges, premiums, or any other financial obligations pertaining to products and services by the respective service providers facilitated via the MetaFin platform. Such products and services shall include, without limitation to MediSavers Healthcare Programs, SME Solutions Programs, or any other products or services introduced under the MetaFin platform.
The Customer acknowledges that financial obligations, which may include Insurance Premiums, may vary due to factors such as changes in age bands, insurer underwriting criteria, regulatory adjustments, or service enhancements. MetaFin shall provide no less than thirty (30) days' written notice prior to implementing any such adjustments. The Customer authorises MetaFin to debit any revised sums from the designated payment method(s).
In the event of any failed or declined payment attempt, whether via credit card, debit card, or bank account, due to reasons including insufficient funds, expired credentials, or transaction rejection, the relevant service provider reserves the right to suspend or terminate the associated membership, policy, or service with immediate effect.
1. Neither MetaFin, Pathlab Health Management (M) Sdn. Bhd. ("PHM") and/or its duly appointed collection agents, nor the relevant Insurance Underwriter(s) shall be liable for claims, losses, or detriment suffered post-termination, except where prohibited by applicable law.
2. The Customer agrees to indemnify and hold harmless MetaFin, PHM, and the Insurance Underwriter(s) from liabilities or disputes arising subsequent to such termination. This indemnity shall be limited to losses directly arising from the Customer’s breach of payment obligations.
Should the Customer wish to discontinue any membership or recurring service administered via the MetaFin platform, written notice must be provided at least sixty (60) days prior to the expiration of the current term. Upon receipt of such notice:
1. Any security deposit maintained with MetaFin shall be applied against any outstanding sum due;
2. Services will continue until the expiry date, unless terminated earlier due to non-payment or breach of these terms.
In circumstances where two (2) successive billing attempts result in non-payment, MetaFin or the relevant service provider reserves the absolute right to cancel the membership, policy, or service with immediate effect.
MetaFin retains discretion to impose administrative surcharges where particular payment methods occasion additional processing burdens. This surcharge will be notified in advance and reflected in the billing cycle.
Monthly Standing Instruction (MSI) Customers are encouraged to use credit cards or FPX-linked savings accounts to ensure service continuity. Recurring debit card transaction failures, including insufficient funds or delayed processing, have been identified as compromising the continuity of services and placing administrative strain upon the platform. To that end, Customers are urged to utilise credit cards or FPX-linked savings accounts for payment.
1. Memberships and recurring services shall, unless otherwise discontinued in accordance with Clause (4), be renewed automatically upon the anniversary of the initial membership term.
2. Fees upon renewal shall be subject to variation for reasons including, without limitation, changes in age bands, insurer underwriting revisions, or service enhancements. Notice of such variations shall be issued not less than thirty (30) days prior to the effective date thereof.
3. The Member may elect to terminate membership by issuing written notice no less than sixty (60) days prior to expiry of the current membership term. Any security deposit held shall be applied against final instalments or outstanding balances.
4. Should payment under the MSI fail for two (2) consecutive months, MetaFin or the applicable service provider reserves the right to cancel the service with immediate effect.
5. MetaFin may, at its sole discretion, vary, delete, or introduce new provisions within these MSI terms. Any such amendments shall be communicated to the Customer with a minimum of thirty (30) days’ prior notice.
Payment Method Policy
1. The Customer is encouraged to utilise credit cards or FPX-linked savings accounts for the settlement of all fees and charges due under these Terms. The purpose is to safeguard uninterrupted service provision, enhance transactional security and operational efficiency; and mitigate administrative disruptions from failed or delayed debit card transactions.
2. The respective service provider responsible for delivering the service retains the discretion to modify accepted payment methods or apply surcharges in accordance with these Terms. Any changes shall be communicated to the Customer with a minimum of thirty (30) days’ prior notice.
Payment information provided by Customers shall be managed in strict accordance with the Personal Data Protection Act 2010 (PDPA) and prevailing industry security standards. MetaFin does not retain payment credentials directly but relies upon duly authorised payment processors.
Refunds, where applicable, shall be administered pursuant to the terms of the respective product or service agreement. MetaFin reserves the right to offset any outstanding liabilities prior to the disbursement of refunds. Refund terms shall remain subject to applicable law and the relevant product or service agreement.
If any payment made via credit/debit card is disputed, reversed, or charged back, MetaFin reserves the right to suspend or terminate the associated membership, policy, or service until the issue is resolved to MetaFin’s satisfaction. The Customer remains liable for any outstanding amounts and any reasonable administrative costs incurred in managing such reversals, including but not limited to bank fees and administrative charges.
In the event of a dispute, both parties agree to attempt to resolve the matter amicably via mediation before resorting to litigation.
All notices and communications under these Terms may be sent electronically and shall be deemed received on the day of transmission.
All payments shall be made in Malaysian Ringgit (MYR) unless otherwise agreed in writing. Any fees, including but not limited to foreign exchange charges, bank transfer fees, or other transaction-related costs incurred in the remittance of payments, shall be borne solely by the Customer.
MetaFin, or the applicable service provider shall have the right to set-off any sums due from the Customer against any monies payable to the Customer under any agreement or arrangement.
MetaFin shall not be liable for failure or delay in performing obligations under these Terms where such failure arises from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, strikes, government restrictions, pandemics, or failures of payment systems or communication networks. Payment obligations are suspended, not extinguished, during such events.
MetaFin may assign or transfer its rights and obligations under these Terms to an affiliate or third-party service provider with prior notice to the Customer.
No failure or delay by MetaFin in exercising any right, power, or remedy provided under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of such right preclude any further exercise of it or the exercise of any other right.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms shall be governed by the laws of Malaysia. Disputes arising hereunder shall fall within the non-exclusive jurisdiction of the Malaysian courts, without prejudice to MetaFin’s right to enforce rights in other jurisdictions. Any conflict of laws principles that would result in the application of laws other than those of Malaysia shall be excluded.
MetaFin retains the prerogative to amend, vary, or supplement these Payment Terms and Conditions from time to time. Customers shall be notified of such amendments no less than thirty (30) days prior to their effective date.

MaximDNA Terms & Conditions:

I hereby apply for the MaximDNA Program and agree, acknowledge, and declare as follows:

1. Acceptance of the Terms

1.1 I agree to be bound by the terms and conditions of the Program as detailed in the Program leaflet and the associated documentation. These terms constitute a legally binding agreement between myself and MXM.

2. Payment Terms and Authorisation

2.1 Payment for the Program shall be as per the accompanying payment form and I agree to adhere to all terms stated therein.

2.2 In the event of a third party's credit card(s) being used for purpose of payment for the Program (“Fee”), I shall obtain proper authorization condoning such usage by ensuring the third-party credit card authorization, accompanied with all relevant legal documents in support of such usage (where applicable). I accept full responsibility for any claims arising in from such usage.

2.3 The pricing of the Program is applicable during the launch period only and is subject to revision. Any changes to the pricing will be communicated promptly.

3. Cooling Off Period

3.1 I acknowledge that this application is subject to a cooling-off period of ten (10) working days from the date of receipt by MXM of this application ("the Cooling Off Period"). During this Cooling Off Period, I acknowledge that I shall be entitled to a refund of the Fee, provided I have not utilised any of the benefits of the Program.

3.2 The cooling-off period does not apply if the contract has commenced, if genetic testing has begun, or under any other circumstances where specific contractual obligations or the nature of the services rendered preclude such a period.

4. Usage and Refunds

4.1 In the event that I have commenced or exhausted any part of the Program or if the Program test kit is incomplete or is not in a reusable condition, MXM may deduct a sum equivalent to the cost of the Program test kit pack, including any associated administration fees, processing fees, logistics or other related costs.

5. Resampling Policy for DNA Sample Processing Failure

5.1 In the event that the laboratory determines the submitted DNA sample does not meet the required standards for analysis – due to insufficient sample quantity, contamination, degradation or improper collection, I understand that I will be required to purchase a new test kit for resubmission. This resampling is essential to ensure the accuracy of the genetic results.

5.2 I understand that I am responsible for collecting and submitting the DNA sample in strict accordance with the instructions provided. Failure to follow the correct procedures may result in the need for further resampling which will result in additional costs.

5.3 I agree to resubmit my DNA sample within 30 days of receiving the new kit to prevent any further delays in the processing of my genetic results.

6. Cancellation Policy

6.1 I acknowledge that cancellation of my membership in the Program is strictly prohibited after the Cooling Off Period and that MXM shall not refund any portion of the Fee thereafter.

7. Entire Agreement

7.1 The terms and conditions herein, together with the Program leaflet and the Program test kit pack shall constitute the entire understanding of the parties superseding any prior agreements or understandings.

8. Declined Payments

8.1 In the event that any cheque or credit card(s) toward payment of the Fee is declined for any reason, the Program will automatically be cancelled. MXM reserves the right to terminate the Program with immediate effect. Any cost incurred under term 4 will automatically be charged to the applicant's assigned credit card as indicated in the payment form.

9. Modification of Terms

9.1 MXM reserves the right to amend the Program benefits or terms at its discretion.

9.2 MXM reserves the right to vary, delete or add any of the Program benefits and/or of terms and conditions at own discretion. All updates and amendments will be posted on our official website. Please refer to our website at www.medisavers.com.my for the latest updates on any amendments.

10. Informed Consent

10.1 By submitting this application, I provide informed consent for the genetic testing process, including the collection, testing, and storage of my genetic information. I acknowledge that I have read and understood the terms and conditions, including the potential risks and benefits of the Program.

11. Acknowledgement of Risks, Benefits and Limitations

11.1 I acknowledge that I have read and understood the potential benefits and risks of genetic testing as provided, but not limited to, those in the application form. These benefits include personalized health insights, family planning information, lifestyle and wellness advice, early disease identification, and participation in research. Potential risks include psychological risks, genetic discrimination, data privacy, impact on family dynamics, medical and ethical concerns, potential limitations of genetic testing.

11.2 Genetic consultation involves revealing sensitive, personal, and private information that may at times be distressing. However, your genetic counsellor is available to support you throughout the process. During the consultation session, you may learn more about how genetic factors contribute to the disorder and affect the risk of disease in yourself or your family members.

11.3 Genetic counselling is not intended to provide medical diagnosis or treatment recommendations; instead, it aims to help you better understand your genetic test report.

12. Results Disclaimer

12.1 The Genetic test results are not intended for diagnostic purposes and should not be used as a substitute for professional medical advice. MXM is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the test results.

13. Privacy and Confidentiality

13.1 MXM is committed to protecting my genetic data and will use advanced security measures to ensure its confidentiality. My genetic data will be used solely for the purposes outlined in the Program and will not be shared with third parties without my explicit consent.

13.2 All interactions with MXM, including scheduling or attendance at appointments, the content of your sessions, progress in counselling, and your records, are confidential. No record of the counselling is provided to a third party unless with your written consent. You may request in writing that the counselling staff release specific information about your counselling to persons you designate. Your genetic counsellor may consult with other specialists or your referring provider(s) to provide the best possible care for you. Your identity will be kept confidential.

14. Collection of Physical Genetic Testing Report

14.1 I acknowledge that I may elect to receive my genetic testing report in physical and/or digital format. Where applicable, if I opt for physical report, I may collect in person, via courier or authorise a designated third party (“Authorised Representative”) to collect on my behalf, I consent to the following:

I authorise MXM, its affiliates, and service contractors to release my physical genetic testing report to the designated Authorised Representative, which may include advisors or other authorised personnel.
I understand that the Authorised Representative is obligated to comply with the applicable laws, concerning the handling and delivery of my genetic testing report in accordance with the Personal Data Protection Act 2010 (PDPA). I acknowledge that my representative is responsible for obligations for upholding the confidentiality of my report and understand the consequences of non-compliance.
I accept that MXM shall not be held liable for any loss, damage, or unauthorised access or misuse of my genetic testing report arising from the actions or omissions of my Authorised Representative in relation to my report once it has been transferred for collection or delivery.

15. Consultation for Genetic Testing

15.1 I acknowledge that the Program includes a fee-based consultation with an appointed genetic counselor to be scheduled upon the availability of my genetic test results. This consultation will provide personalised insights based on the member's invidividual genetic profile, to facilitate client understanding and interpretation of their genetic test results.

15.2 By signing this application form for Genetic Consultation I may consult a genetic counsellor and acknowledge that I understand the following:

I have discussed my medical concern with my healthcare provider and receive this referral to a genetic consultant for consultation.
I will be contacted by the genetic consulting team through the contact information provided.
I understand that the genetic consultant is NOT A PHYSICIAN. I will still need to consult with my physician for medical and treatment advice, including the diagnosis of any condition and the recommendations for medical management related to my diagnosis.
I agree to provide a complete and accurate medical history, and share my original laboratory test reports, imaging results, and other documents pertinent to my medical concerns during the counselling session.
The recommendations from the genetic consulting session will depend on the accuracy of the family history provided, Issues of non-paternity could affect the evaluation of family history.
Record of the consultation, video, audio, and/or photo recordings may be collected, stored, or otherwise processed during the procedure to aid in documenting the progress of my medical management.

Upon provision of credit card, debit card, or bank account particulars, the Customer hereby grants express authorisation to MetaFin Sdn. Bhd. ("MetaFin") and/or its duly appointed collection agents (which shall include, inter alia, iPay88, Razer Merchant Services, Curlec, and any other such entities as may be appointed from time to time) to deduct all sums due in respect of Membership Fees, charges, premiums, or any other financial obligations pertaining to products and services by the respective service providers facilitated via the MetaFin platform. Such products and services shall include, without limitation to MediSavers Healthcare Programs, SME Solutions Programs, or any other products or services introduced under the MetaFin platform.
The Customer acknowledges that financial obligations, which may include Insurance Premiums, may vary due to factors such as changes in age bands, insurer underwriting criteria, regulatory adjustments, or service enhancements. MetaFin shall provide no less than thirty (30) days' written notice prior to implementing any such adjustments. The Customer authorises MetaFin to debit any revised sums from the designated payment method(s).
In the event of any failed or declined payment attempt, whether via credit card, debit card, or bank account, due to reasons including insufficient funds, expired credentials, or transaction rejection, the relevant service provider reserves the right to suspend or terminate the associated membership, policy, or service with immediate effect.
1. Neither MetaFin, Pathlab Health Management (M) Sdn. Bhd. ("PHM") and/or its duly appointed collection agents, nor the relevant Insurance Underwriter(s) shall be liable for claims, losses, or detriment suffered post-termination, except where prohibited by applicable law.
2. The Customer agrees to indemnify and hold harmless MetaFin, PHM, and the Insurance Underwriter(s) from liabilities or disputes arising subsequent to such termination. This indemnity shall be limited to losses directly arising from the Customer’s breach of payment obligations.
Should the Customer wish to discontinue any membership or recurring service administered via the MetaFin platform, written notice must be provided at least sixty (60) days prior to the expiration of the current term. Upon receipt of such notice:
1. Any security deposit maintained with MetaFin shall be applied against any outstanding sum due;
2. Services will continue until the expiry date, unless terminated earlier due to non-payment or breach of these terms.
In circumstances where two (2) successive billing attempts result in non-payment, MetaFin or the relevant service provider reserves the absolute right to cancel the membership, policy, or service with immediate effect.
MetaFin retains discretion to impose administrative surcharges where particular payment methods occasion additional processing burdens. This surcharge will be notified in advance and reflected in the billing cycle.
Monthly Standing Instruction (MSI) Customers are encouraged to use credit cards or FPX-linked savings accounts to ensure service continuity. Recurring debit card transaction failures, including insufficient funds or delayed processing, have been identified as compromising the continuity of services and placing administrative strain upon the platform. To that end, Customers are urged to utilise credit cards or FPX-linked savings accounts for payment.
1. Memberships and recurring services shall, unless otherwise discontinued in accordance with Clause (4), be renewed automatically upon the anniversary of the initial membership term.
2. Fees upon renewal shall be subject to variation for reasons including, without limitation, changes in age bands, insurer underwriting revisions, or service enhancements. Notice of such variations shall be issued not less than thirty (30) days prior to the effective date thereof.
3. The Member may elect to terminate membership by issuing written notice no less than sixty (60) days prior to expiry of the current membership term. Any security deposit held shall be applied against final instalments or outstanding balances.
4. Should payment under the MSI fail for two (2) consecutive months, MetaFin or the applicable service provider reserves the right to cancel the service with immediate effect.
5. MetaFin may, at its sole discretion, vary, delete, or introduce new provisions within these MSI terms. Any such amendments shall be communicated to the Customer with a minimum of thirty (30) days’ prior notice.
Payment Method Policy
1. The Customer is encouraged to utilise credit cards or FPX-linked savings accounts for the settlement of all fees and charges due under these Terms. The purpose is to safeguard uninterrupted service provision, enhance transactional security and operational efficiency; and mitigate administrative disruptions from failed or delayed debit card transactions.
2. The respective service provider responsible for delivering the service retains the discretion to modify accepted payment methods or apply surcharges in accordance with these Terms. Any changes shall be communicated to the Customer with a minimum of thirty (30) days’ prior notice.
Payment information provided by Customers shall be managed in strict accordance with the Personal Data Protection Act 2010 (PDPA) and prevailing industry security standards. MetaFin does not retain payment credentials directly but relies upon duly authorised payment processors.
Refunds, where applicable, shall be administered pursuant to the terms of the respective product or service agreement. MetaFin reserves the right to offset any outstanding liabilities prior to the disbursement of refunds. Refund terms shall remain subject to applicable law and the relevant product or service agreement.
If any payment made via credit/debit card is disputed, reversed, or charged back, MetaFin reserves the right to suspend or terminate the associated membership, policy, or service until the issue is resolved to MetaFin’s satisfaction. The Customer remains liable for any outstanding amounts and any reasonable administrative costs incurred in managing such reversals, including but not limited to bank fees and administrative charges.
In the event of a dispute, both parties agree to attempt to resolve the matter amicably via mediation before resorting to litigation.
All notices and communications under these Terms may be sent electronically and shall be deemed received on the day of transmission.
All payments shall be made in Malaysian Ringgit (MYR) unless otherwise agreed in writing. Any fees, including but not limited to foreign exchange charges, bank transfer fees, or other transaction-related costs incurred in the remittance of payments, shall be borne solely by the Customer.
MetaFin, or the applicable service provider shall have the right to set-off any sums due from the Customer against any monies payable to the Customer under any agreement or arrangement.
MetaFin shall not be liable for failure or delay in performing obligations under these Terms where such failure arises from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, strikes, government restrictions, pandemics, or failures of payment systems or communication networks. Payment obligations are suspended, not extinguished, during such events.
MetaFin may assign or transfer its rights and obligations under these Terms to an affiliate or third-party service provider with prior notice to the Customer.
No failure or delay by MetaFin in exercising any right, power, or remedy provided under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of such right preclude any further exercise of it or the exercise of any other right.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms shall be governed by the laws of Malaysia. 14. Collection of Physical Genetic Testing Report

I authorise MXM, its affiliates, and service contractors to release my physical genetic testing report to the designated Authorised Representative, which may include advisors or other authorised personnel.
I understand that the Authorised Representative is obligated to comply with the applicable laws, concerning the handling and delivery of my genetic testing report in accordance with the Personal Data Protection Act 2010 (PDPA). I acknowledge that my representative is responsible for obligations for upholding the confidentiality of my report and understand the consequences of non-compliance.
I accept that MXM shall not be held liable for any loss, damage, or unauthorised access or misuse of my genetic testing report arising from the actions or omissions of my Authorised Representative in relation to my report once it has been transferred for collection or delivery.

15. Consultation for Genetic Testing

15.2 By signing this application form for Genetic Consultation I may consult a genetic counsellor and acknowledge that I understand the following:

I have discussed my medical concern with my healthcare provider and receive this referral to a genetic consultant for consultation.
I will be contacted by the genetic consulting team through the contact information provided.
I understand that the genetic consultant is NOT A PHYSICIAN. I will still need to consult with my physician for medical and treatment advice, including the diagnosis of any condition and the recommendations for medical management related to my diagnosis.
I agree to provide a complete and accurate medical history, and share my original laboratory test reports, imaging results, and other documents pertinent to my medical concerns during the counselling session.
The recommendations from the genetic consulting session will depend on the accuracy of the family history provided, Issues of non-paternity could affect the evaluation of family history.
Record of the consultation, video, audio, and/or photo recordings may be collected, stored, or otherwise processed during the procedure to aid in documenting the progress of my medical management.
